Terms of Service
Last updated: October 6, 2026
These terms are an agreement between you and 3005 Productions ("we", "us"), a business run by Dwight Robinson in New York. They cover your use of 3005productions.com and any session you book through it. When you book a session, you'll be asked to agree to these terms. If you don't agree, please don't use the site or book through it.
Please read Section 10 carefully. It says most disputes will be settled by binding arbitration on an individual basis, not in court and not as part of a class action. You can opt out within 30 days, as explained there.
1. Our services
We offer photography and film, smart home and technology consulting, AI agent setup, IT and cybersecurity guidance, website design, resume and LinkedIn help, and home search coaching. The details of any session (what's included, timing, price if any, and how rescheduling and cancellation work) are confirmed with you in writing before the session. If that written confirmation and these terms ever disagree, the written confirmation controls for that session.
Booking a time through the site requests that time. We may confirm, move, or decline a booking, and we'll tell you if we do. Consulting and coaching sessions are guidance and education. They aren't legal, financial, real estate brokerage, or other licensed professional services, and you decide what to do with the guidance. Resume and LinkedIn help improves how you present your experience; it doesn't guarantee an interview, an offer, or a job.
2. Using the site
You agree not to:
- give false information or book for someone else without their permission;
- try to get into parts of the site or its systems you aren't allowed to use;
- send spam, automated requests, or anything designed to overload or harm the site;
- copy, scrape, or reuse our photos, writing, or design without our written permission;
- use the site for anything unlawful or to harm anyone.
3. Our content
The photos, video, writing, logos, and design on this site belong to 3005 Productions or the people who licensed them to us, and are protected by copyright and trademark law. You may view and share links to the site for personal use. Rights to photos or video we create for you are set out in your session's written confirmation.
4. Your reviews
Nothing in these terms limits your right to post an honest review of us, anywhere, or makes you pay anything or give up any rights for doing so.
5. Disclaimer: provided "as is"
To the fullest extent the law allows, the site, the booking system, and all information on them are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise the site will always be available, uninterrupted, error-free, or free of bugs, or that data you send through it will never be lost or delayed.
Some places don't allow certain warranties to be disclaimed, so parts of this section may not apply to you.
6. Limitation of liability
To the fullest extent the law allows, 3005 Productions and Dwight Robinson won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of the site or our services, including from bugs, crashes, outages, or errors, even if we were told they were possible. Our total liability for any claim relating to the site or our services is limited to the greater of the amount you paid us for the service the claim is about in the 12 months before the claim, or $100.
This section doesn't limit liability that the law doesn't allow to be limited, such as liability for gross negligence, willful misconduct, fraud, or personal injury caused by our negligence.
7. Your responsibility for claims (indemnification)
If someone brings a claim against us because you broke these terms, misused the site, broke the law, or violated someone else's rights, you agree to defend us and pay the losses, damages, and reasonable attorneys' fees and costs that result, to the extent the law allows. We'll tell you about the claim promptly, and we may choose to handle the defense ourselves, in which case you'll cooperate with us. This doesn't apply to claims caused by our own wrongdoing.
8. Suspension and termination
We may suspend or end your access to the site or our booking system, and decline or cancel any booking, at our discretion and at any time, including if we believe you've broken these terms or put us or others at risk. If we cancel a session you paid for and it wasn't because you broke these terms, we'll refund what you paid for the part we didn't provide. You can stop using the site at any time. Sections 3 through 12 continue to apply after your use ends.
9. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules, except that Section 10 is governed by the Federal Arbitration Act. Any dispute that isn't arbitrated under Section 10 will be heard in a state or federal court located in New York, and you and we agree to those courts' jurisdiction.
10. Disputes: arbitration and class action waiver
Talk to us first. Before starting any formal claim, email info@3005productions.com with a short description of the problem and what you're asking for. We'll both try in good faith to resolve it within 30 days.
Binding individual arbitration. If we can't resolve it, any dispute or claim between you and us relating to the site, our services, or these terms will be settled by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You and we are each giving up the right to a trial by jury and the right to have a judge decide the dispute.
- Small claims court. Either of us may instead bring an individual claim in small claims court if it qualifies there.
- Costs. Filing fees and arbitrator compensation are paid as the AAA Consumer Arbitration Rules require, which limit what a consumer pays to file.
- Where. Hearings take place by video or phone, or in the county where you live, unless you and we agree otherwise.
- Not covered. Either of us may go to court to stop infringement or misuse of intellectual property, such as our photos or trademarks.
Class action waiver. You and we may bring claims against each other only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims or preside over any class or representative proceeding.
If a court decides the class action waiver can't be enforced for a particular claim, that claim (and only that claim) will be decided in court, not in arbitration.
Opting out. You can opt out of this Section 10 by emailing info@3005productions.com within 30 days after you first agree to these terms, with your name and the words "arbitration opt-out". Opting out doesn't affect the rest of these terms.
11. Changes to these terms
We may update these terms. We'll change the date at the top, and a booking uses the terms in effect when you make it. Changes won't apply to a dispute we already know about.
12. The rest
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given it up. These terms, our Privacy Policy, and any written confirmation for your session are the whole agreement between us about the site. You can't transfer your rights under these terms without our permission; we may transfer ours to a business that takes over 3005 Productions.
